Should companies set prices using your personal data?

On Oct. 28, 2026, the FTC, in a 2-0 commission vote, ordered nine companies (Delta, United, JetBlue, Lyft, Uber, DoorDash, Instacart, Target and Walmart) to explain whether prices or gig-worker pay vary by person based on personal data. It is an information request for a study, not a lawsuit, a ban, or a finding of wrongdoing. Supporters such as the National Retail Federation say data-driven discounts reward loyalty, while many public commenters urged the FTC to ban the practice.
